Terms and Conditions for City Move Property

These Terms and Conditions (“Terms”) govern the relationship between CITY MOVE PROPERTY (“we”, “us”, “our”) and you, the client (“you”, “the Client”). By reserving a property or engaging with our services, you agree to be bound by these Terms.

1. Reservation Fee

1.1. Payment of Reservation Fee

To reserve a property and remove it from our listings, a non-refundable reservation fee of £500 (plus applicable VAT) is required. This fee secures the property exclusively for you and ensures that it is removed from the market.

1.2. Refund of Reservation Fee

The reservation fee of £500 will be refunded in full if you decide to proceed with the purchase of the property and go ahead with the transaction. The fee will be credited toward the total purchase price or the sourcing fee (as applicable).

1.3. Non-Refundable Fee

If you choose not to proceed with the property purchase, the £500 reservation fee will not be refunded. This fee is non-refundable except under the conditions listed in Section 1.2.

1.4. Property Hold Period

The reservation fee holds the property exclusively for you for a period of 7 calendar days, during which you have the opportunity to complete your due diligence and confirm your intent to proceed with the transaction.

1.5. Re-listing of Property

If no decision is communicated to us within the 7-day period, the property will be re-listed and the reservation fee will be forfeited.

2. Sourcing Fee

2.1. Fee Structure

The sourcing fee for securing a property is between 1.33% and 2.83% of the total purchase price, subject to a minimum fee of £4,995 (plus applicable VAT). The final fee percentage will be determined based on the complexity of the transaction and specific terms agreed upon.

2.2. Payment in Instalments

The sourcing fee will be paid in 3 instalments as follows:

  • First Instalment – 30% of the total sourcing fee (plus applicable VAT), payable upon confirmation of intent to proceed with the purchase and payment of the reservation fee.
  • Second Instalment – 30% of the total sourcing fee (plus applicable VAT), payable within 1-2 weeks of the first payment.
  • Final Instalment – 40% of the total sourcing fee (excluding VAT), payable upon completion of the property purchase (i.e., when the sale has been legally finalised, and funds have been exchanged).

2.3. Payment Terms

  • All instalments will be collected by Direct Debit as agreed upon at the time of booking. By proceeding with the reservation and sourcing services, you authorise CITY MOVE PROPERTY to collect payments through Direct Debit.

3. Payment Method: Direct Debit

3.1. Direct Debit Guarantee

All payments for the reservation and sourcing fee will be collected by Direct Debit, and you are fully protected under the Direct Debit Guarantee, which includes:

  • The Right to a Refund: If any payment is taken in error, you are entitled to a full refund.
  • Advance Notice: You will be notified of the amounts and dates on which payments will be taken from your account. This notification will be sent to you in advance.
  • Right to Cancel: You may cancel your Direct Debit at any time by contacting your bank or CITY MOVE PROPERTY. However, cancellation may result in the forfeiture of the reservation fee or the suspension of the transaction process.

3.2. Setting Up Direct Debit

  • Direct Debit payments will be set up upon your agreement to proceed with the reservation and sourcing fee. You will need to provide your bank details and authorise CITY MOVE PROPERTY to initiate the payments through the Direct Debit system.

3.3. Payment Schedule

Payments will be collected in the following manner:

  •  First Instalment: 30% of the total sourcing fee (excluding VAT), collected immediately upon confirmation of intent to proceed with the purchase.
  •  Second Instalment: 30% of the total sourcing fee (excluding VAT), collected within 1-2 weeks of the first payment.
  • Final Instalment: 40% of the total sourcing fee (excluding VAT), collected upon completion of the property purchase.

3.4. Changes to Payment Schedule

If there is any need to modify the payment schedule, you will be contacted in advance for approval. All changes to the schedule must be mutually agreed upon in writing.

4. General Conditions

4.1. No Financial or Legal Advice

We do not provide financial, mortgage, tax, or legal advice. It is strongly recommended that you seek professional advice and carry out your own due diligence before proceeding with any property purchase.

4.2. Changes to Terms

We reserve the right to amend these Terms at any time. Any updates will be made available on our website or upon request.

4.3. Taxes

All fees are stated in GBP and are exclusive of VAT unless otherwise specified. It is your responsibility to pay any applicable taxes or duties related to your transaction.

4.4. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales.

5. Miscellaneous

5.1. Limitation of Liability

CITY MOVE PROPERTY will not be liable for any loss, damage, or injury arising from your use of our platform or services, except as specifically outlined in these Terms.
